BreakIQ Terms of Use & End-User License Agreement

BreakIQ ("the app") is operated by Triple 3 LLC ("we", "us"). By creating an account or using the app you agree to these Terms of Use, which include the End-User License Agreement in section 10. If you do not agree, do not use the app.

1. Use of the app; not for navigation or safety

BreakIQ is a decision-support tool for offshore sport fishing that surfaces oceanographic data and habitat-suitability predictions ("HSI").

The app is an ancillary planning aid only and must not be used for navigation. Only official government charts and Notices to Mariners contain all the information needed for safe navigation. BreakIQ hotspot pins, HSI scores, depth contours, and forecast layers are algorithmic estimates for planning purposes only — they are not guarantees of fish presence, conditions, or safety, must not be relied upon as the sole source of any decision, and must not be used for navigation or route-finding.

Offshore fishing is inherently dangerous. You assume all risk of weather, sea state, and vessel operation. BreakIQ is not a safety, distress, or weather-routing service and is not a substitute for proper safety equipment, an EPIRB, official marine weather forecasts, or the captain's own judgment. You remain solely responsible for vessel safety, seamanship, navigation, weather decisions, and compliance with all fishing regulations, including NOAA Highly Migratory Species (HMS) rules. You must independently verify all conditions, and you use the app at your own risk.

2. Eligibility and accounts

You must be at least 18 years old to hold an account. You are responsible for activity under your account and for keeping your sign-in secure. You may delete your account at any time from within the app (Settings → Account → Delete account) or by emailing us. We may suspend or terminate access for fraud, abuse, or violation of these terms.

3. Subscriptions and billing

BreakIQ offers optional auto-renewing subscriptions, purchased through the App Store or Google Play:

The price and billing period shown in the app at the time of purchase govern, and may vary by region and currency. Payment is charged to your App Store or Google Play account at confirmation of purchase. A subscription automatically renews for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends. You can manage or cancel a subscription in your App Store or Google Play account settings — uninstalling the app does not cancel a subscription or turn off auto-renewal. All purchases made through the App Store or Google Play are also governed by the terms of that distribution channel. Except where required by law or by the app store's policies, payments are non-refundable; refund requests for App Store purchases are handled by Apple.

4. Your catch data

Your catches belong to you; we do not claim ownership of your content. You grant us a limited, non-exclusive, royalty-free license to use your catch data solely to operate the app for you and — in privacy-preserving aggregate only, with a random 200–2000 m coordinate displacement and a k-anonymity threshold of at least 5 contributors — to improve the prediction model for all captains. This license is scoped to running and improving the service; we do not license your content for advertising or sell it. See the Privacy Policy for full detail.

5. Accuracy

We publish a rolling accuracy dashboard at our accuracy dashboard. We do not warrant any specific forecast accuracy. If the dashboard is offline or stale, we withdraw any "most accurate" marketing claim until it is restored.

6. Acceptable use

You agree not to reverse engineer, resell, or redistribute the app's data or predictions except as expressly permitted; not to use the app for any unlawful purpose; and not to attempt to breach its security or access data that is not yours.

7. Intellectual property

The app, its predictions, models, and content (excluding public data sources and your own catch data) are owned by Triple 3 LLC. Subject to these terms, we grant you a personal, non-transferable, revocable license to use the app.

8. Disclaimers and limitation of liability

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Triple 3 LLC is not liable for any indirect, incidental, special, or consequential damages, or for any damages arising from your use of the app — including lost catches, lost fishing days, equipment loss, property damage, or personal injury. Where liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the 12 months before the claim or fifty U.S. dollars.

9. Governing law and disputes

These terms are governed by the laws of the United States and the State of Maryland, without regard to conflict-of-laws rules, except where your local consumer-protection law provides otherwise. Before filing any claim, you agree to contact us and attempt to resolve it informally for at least 30 days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Maryland, and you consent to their jurisdiction, except where applicable law grants you the right to your local courts.

10. End-User License Agreement (Apple App Store)

This EULA applies to your use of the BreakIQ app obtained through the Apple App Store. You acknowledge and agree:

  1. Parties. This EULA is between you and Triple 3 LLC only, and not with Apple. Triple 3 LLC, not Apple, is solely responsible for the app and its content.
  2. Scope of license. Triple 3 LLC grants you a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the App Store Terms of Service.
  3. Maintenance and support. Triple 3 LLC is solely responsible for any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support.
  4. Warranty. Triple 3 LLC is solely responsible for any product warranties, whether express or implied. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  5. Product claims. Triple 3 LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product-liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection or privacy law.
  6. Intellectual property. In the event of a third-party claim that the app or your use of it infringes that party's intellectual property rights, Triple 3 LLC, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
  7. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Developer contact. Questions, complaints, or claims about the app should be directed to Triple 3 LLC at support@breakiq.app.
  9. Third-party terms. You must comply with any applicable third-party terms of agreement when using the app.
  10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance, Apple will have the right (and is deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

If you obtained the app through Google Play, your use is also subject to the Google Play Terms of Service, and the responsibilities above apply to Triple 3 LLC and Google in the equivalent manner.

11. Changes to these terms

We may update these terms as the app evolves. We will update the "Last updated" date above and, for material changes, provide reasonable notice. Continued use after changes take effect means you accept them.
